Terms of Service

Havyn is operated by Alpha Global Tech and Consulting (“AGT”, “we”, “us”, or “our”), a company registered in Nigeria. In these Terms, “Havyn” or the “service” means our websites at gethavyn.app, our mobile and web applications, and related services.

By registering for, accessing, or using Havyn, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you are entering into these Terms on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to that organization. If you do not agree, do not use the service.

• You must be at least 18 years old to create an account or administer an organization on Havyn.
• You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
• You are responsible for all activity that occurs under your account, and you must notify us promptly of any unauthorized use.

Havyn helps organizations such as worship centers, schools, and daycares check children in and out, verify who is authorized to collect them, and keep a record of those events. We may add, change, or remove features over time to improve the service.

When your organization uses Havyn to record information about children, guardians, and staff, your organization is the party that decides what information is collected and why. Accordingly, you agree that:

• You will obtain and maintain all consents and authorizations required under applicable law, including consent from parents or legal guardians, before entering a child’s information into Havyn.
• You will use Havyn only for legitimate child check-in, custody, and safeguarding purposes, and in compliance with all laws that apply to you.
• You are responsible for the accuracy of the records you create and for managing access by your own administrators and workers.
• You will respond to requests from the individuals whose data you control (for example, a parent asking to access or delete their child’s record), as described in our Privacy Policy.

You agree not to:

• Use the service for any unlawful, harmful, or fraudulent purpose, or in any way that endangers a child.
• Attempt to gain unauthorized access to the service, other accounts, or our systems, or circumvent any security or access controls.
• Copy, scrape, reverse engineer, resell, or sublicense the service except as expressly permitted.
• Upload malicious code or interfere with the integrity or performance of the service.
• Misrepresent your identity or your authority to act for an organization.

• Havyn offers free and paid subscription plans. The features and limits of each plan are described in the app and on our pricing page.
• Paid subscriptions are billed in advance through our payment processor (Paystack) on the web. By subscribing, you authorize the applicable charge for the billing period you select (monthly or annual).
• Subscriptions continue for the period you pay for. Unless stated otherwise, fees are non-refundable except where required by law.
• We may change plan pricing or features on reasonable notice. Changes take effect at your next renewal.
• You are responsible for any taxes associated with your use of the service, other than taxes on our income.

Havyn, including its software, design, and content, is owned by AGT and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the service in accordance with these Terms and our Licence. We reserve all rights not expressly granted. The data your organization enters remains yours, and our handling of it is described in the Privacy Policy.

Our Privacy Policy explains how we collect, use, and protect personal information, including the special care we take with children’s data. By using Havyn, you also agree to the Privacy Policy.

Havyn relies on third-party providers (for example, for hosting, payments, push notifications, email, and SMS). Your use of those features may be subject to the third party’s own terms. We are not responsible for third-party services we do not control.

You may stop using Havyn at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the service or its users, including the safety of children. On termination, your right to use the service ends. We may retain or delete data as described in the Privacy Policy and as required by law.

Havyn is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure. Havyn is a tool to support your safeguarding processes; it does not replace the judgment and supervision of your staff.

To the fullest extent permitted by law, AGT will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to the service will not exceed the amount you paid us for the service in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify and hold AGT harmless from claims, losses, and expenses arising out of your use of the service, your data, or your breach of these Terms or of any law, including data protection law.

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, for example through the app or by email. Your continued use of Havyn after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the Federal Republic of Nigeria. The courts of Lagos State, Nigeria, will have jurisdiction over any dispute, without prejudice to any mandatory consumer protections available to you under the law of your place of residence.
